(You remember H. C (Hamilton Cooper) Rutland was the father of Mary Elizabeth Rutland Culpepper.) The Aug 7, 1902 date is in line with the death date on the tombstone in Rutland cemetery. Aug 1, 1902.
Interestingly, between Aug 1, 1902 and Jan 1, 1903, H. C. Rutland filed a lawsuit against Tom Chain and M. M. Culpepper. And, Defts, (Tom Chain and M. M. Culpepper) filed an answer and cross bill April 15, 1903

Mary Rutland Culpepper died in 1902 and Matthew remarried to another woman also named Mary. This would explain the 1910 and 1920 census. But..there is that BLM record, dated June 6, 1906 in the name of Mary E Culpepper, formerly Mary E Rutland, jr. And, it doesn't say, Estate of M. E. Culpepper, dec. But, then there is that tombstone.

I think I told you about the court papers where Mary's father was appointed guardian of her estate and had filed a lawsuit against Matthew. Well, I haven't found the papers on the lawsuit but I did find something else.
Matthew and Mary had a daughter, Bertha, b in 1902. This is confirmed by the probate of Mary's brother's estate in 1927. William N. Rutland had 3 heirs. Richard Rutland, Frances Rutland and a neice, Bertha Gentry. Bertha is found in 1920 living next door to Hamilton Cooper Rutland, Mary's father, and in 1930 her youngest son is named Matthew. I am thinking that she named a son after her father, after the death of H. C. After I found this Bertha Gentry, it dawned on that H. C. wouldn't have been appointed guardian of Mary's estate unless a child was involved.
I was at the courthouse in Collins today and found a divorce record for Mary Culpepper and M. M. Culpepper, March term, 1920. In her filing, Mary (MNU) said she and Matthew were married Oct 22, 1902 and seperated Nov 9, 1918. Matthew's post office address and whereabouts were unknown.

The complaint and the newspaper clipping of the citation that was issued for Matthew are all that was in the file.
